fiscal cliff. so, bret baier, welcome to you. all the news trickling out today, but it looks like at least the house of representatives will not vote on any deal to avoid the fiscal cliff. what is the latest? >> seconds ago, confirmation that, in fact, the house will not take up any fiscal cliff vote tonight even if the senate manages to get a piece of legislation to the floor and gets over the hurdles we have talked about. if there are the votes to get it on the senate side question confirm, right now, from our people on capitol hill, including chad, who you just talked to, the house will not take up any fiscal cliff vote even if the senate does pass something tonight as you look at the senator from missouri speaking on the senate floor. that means the country is going over the fiscal cliff technically. as we have known congress to do before, you can have maneuvers by which they rewind the clock and if they go into tomorrow and they actually pass a piece of legislation they can rewind it to the point they need to be. some of the stipulations about the sequester and those are the across-the-board cuts

fiscal cliff is really in view now. the home county of house speaker john boehner butler county, ohio, currently under a blizzard warning. house republican leaders holding a conference call earlier today on the fiscal cliff, but so far they have not yet called on lawmakers to return to capitol hill. but they have said they will give a 48 hour warning if they plan to do that the white house saying the president is cutting his holiday vacation in hawaii short to return to d.c. to work on a deal to try to stop those automatic tax hikes and deep spending cuts from kicking in on january 1st. and if they don't reach a deal before then, many economists say we will dip back into a recession. i had henly house republican leaders didn't have a lot of new information for their lawmakers. they would have 48 hour notice if they are needed to pray back to washington from various districts around the country. that tells us they are being noncommittal at this point because they frankly do not know whether or not there will be a deal to avert the fiscal cliff. now, after that conference call. the hous

we're days away from actually going off the fiscal cliff where these automatic massive spending cuts as well as large tax increases got into effect you have to have low expectations. it appears the white house is very confident in waiting for the republicans to make the next move. they keep saying inside the white house this is up to the republicans. they're the impediment here. when you listen to senate republican leader mitch mcconnell he basically said yesterday when he got a phone call from the president two nights ago it was the first time he heard from a democrat about the fiscal cliff negotiations, whether the president, senator reid or others in about a month, around thanksgiving. with the democrats not reaching out to senator mcconnell for a month, doesn't seem like they have been pushing very hard for a deal, gregg. gregg: has the bickering between reid and boehner sort of poisoned the negotiations past the point that, you know, maybe this meeting will help at all? >> reporter: it may have because it's really, we've seen tensions escalate ever since before christmas when john boehner was not able to get a deal through the house where he has a very strong republican majority. he had a

are the house will not vote on any fiscal cliff legislation tonight. here is how the potential deal stacks up. they will be taxed at 39.6%. up from 35%. tax on capital gain and individuals for $400,000 for individuals would increase to 20%. from 15%. the alternative minimum tax is permanently indexed to inflation. it has been annual patch. that would be permanent. the plan extent the child tax red earned income tax credit. up to $2,500 tax credit for collision tuition. unemployment benefit are extented for one year. same for the medicare doc fix and the social security payroll tax cut. reverse to rate of 6.2%. those are the deals as they stand right now. although things are developing and they could change. those looking to europe for inspir ration and coming up with american tax rates that target the rich may have to rethink the strategy based on a ruling by a french court. senior foreign affairs correspondent greg palkot has that story. >> proponents of the high taxes in france took a bit of a hit over the weekend. >> the french constitutional council or court ruled plan 75% tax o

. probably celebrating because they just got word from the white house that there is a deal, a fiscal cliff deal. the problem is the dancing may not be happening all the way up here on capitol hill because, frankly, it still has to pass the senate and the house. but they can still cheer. i'm bret baier live in washington. we have the breaking news that they are very close they say to the final deal between senate democrats and republicans and vice president biden who is currently meeting with senate democrats in a closed door meeting trying to get skeptical democrats to sign on to the mini deal that they are trying to avoid the fiscal cliff. the problem that they won't avoid it technically. they will miss the midnight deadline because the house has adjourned for the night. they don't have anything to score. they don't have anything to react to because no piece of legislation has made it to the senate. this s the shot we have been looking at for a long time just outside the senate chamber. if you just turn the camera a little bit you would see the door to the senate and so far there is nothing to vote on. the bill has to come from the senate to go to the house. the house will then react to it and that is really the question mark about how that is

. of course, that's the other big issue in this fiscal cliff standoff. we have team fox coverage. mike emanuel is live on capitol hill. but first to ed henry at the white house. ed, it looks as if we are taking the plunge. >> it does, trace. but what i think the white house is hoping here tonight is that lawmakers are going to have some framework by midnight tonight that basically says votes as soon as tomorrow or maybe even in early wee hours, 1:00 a.m., 2:00 a.m. to start moving forward on this so at least the markets get the signal that they will retroactively make sure that the tax rates don't go up. that the massive spending cuts don't take effect. all of this is still hanging in the balance. as you mentioned, conservatives not happy that there are no new spending cuts here. liberals not happy over the fact that they believe the president gave in too much to republicans on taxes setting a threshold of $450,000 a year instead of what they wanted which was 250,000. bottom line the president said that's the art of the compromise today. everyone is not going to get everything that they want. and, in fact, he said the key here is to make sure that taxes don't go

playing a part in this fiscal cliff negotiation, this is the latest gallup polling around christmas time. none of them faired too well. the president does the best. but we have house speaker john boehner, approval is 26% and harry reid, 34%. doug, who steps up and shows some leadership at this moment? >> well, the president's overall approval rating is pretty high, i think, he is in the mid-50s, about the highest he has been in some time. i think it's going to be, in the short term, it's mcconnell and reid. can it pass the house? that will be up to john boehner's leadership. i think that john boehner wants to get something done. he is a deal maker. but he has 80, 90, 100 members in the caucus who refuse to take yes for an answer, as the president said. so i agreew on the overall issue of the debt. i think that's why the president put forward a plan on a grand bargain to get $4 trillion in deficit reduction, but that wouldn't have been able to pass the house. so, short term, mcconnell and reid, they are dealt makers. they have done this before. long term or over the next two, three, four week, it will be in john boehner's hands with the president doing a lot of prodding. >
